*This is the initial service fee for a Non-Provisional Patent Application. Because fees vary by invention type, there may or may not be additional fees along the process.
To qualify as a micro entity, you must meet the following criteria:
- Typically an individual or small group
- Has not been named as an inventor on more than 4 prior patent applications
- Gross income less than 3 times the amount reported as the median household income for preceding year (currently $206,109)
- If group, typically a nonprofit organization, university, or company with fewer than 500 employees
- Has not assigned or licensed interest in the invention to a non-small entity
Please note: If more than one inventor will be on the patent application, each inventor must individually meet this criteria. For example, if there are 2 inventors on a patent application and one makes $250,000 a year, the patent application would not qualify as a micro-entity even if the other inventor only makes $10,000 a year.
